1. Scope and provider

These Terms of Use govern the use of the website www.controlia.de and the handling of requests submitted via the contact form. The provider is Nockta GmbH, Niederwerrnerstr. 20, 97421 Schweinfurt, Germany (the "Provider"). Full provider information is available in the Legal Notice (Impressum).

2. Purpose of the website

The website provides information about the "ControlIA" software product and the ability to request a non-binding product demonstration. No paid contract for the use of the software is concluded via the website. Contractual terms for paid use of the software are agreed separately.

3. Demo requests

A request submitted via the contact form is not a legally binding order but merely a non-binding expression of interest in a product presentation. The Provider is entitled to refuse requests without stating reasons. Submitting the form does not establish any entitlement to a demo.

4. Use of the website

Use of the website is free of charge and is intended for businesses and their authorised employees. Distribution, reproduction or commercial use of the content is only permitted with the express written consent of the Provider. The Provider reserves the right to modify the website at any time, restrict individual functions or discontinue operation.

5. Availability

The Provider endeavours to ensure the highest possible availability of the website but cannot guarantee uninterrupted accessibility. Maintenance, technical disruptions or third-party interference may lead to temporary limitations.

6. Liability

The Provider is liable without limitation in cases of intent, gross negligence or injury to life, body or health. Otherwise, liability is limited to foreseeable damages typical for this type of contract. Any further liability, in particular for indirect damages, loss of profit or data loss, is excluded as far as legally permissible.

The website may contain references to third-party content (links, logos, trademarks). The Provider is not responsible for such content; the terms of the respective providers apply. Trademarks mentioned in the content (e.g. Amazon, Mentor) are the property of their respective owners.

9. Applicable law and jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the user is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these terms is Schweinfurt, Germany.

10. Severability

Should individual provisions of these terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the legally permissible provision that comes closest in economic terms to the purpose of the invalid provision.
